Welcome to the E-Paper of the Echo of Arunachal, which is owned, managed and operated by Echo Of Arunachal, V.I.P Road, Bank Tinali, Itanagar, Arunachal Pradesh.

YOUR ACCESS OR USE OF THE WEBSITE OR SERVICE SHALL MEAN THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS. BY ACCESSING OR USING THE WEBSITE OR SERVICES YOU ALSO WARRANT TO ACCEPT THE TERMS ON BEHALF OF YOURSELF AND/OR ANY OTHER PERSON YOU REPRESENT IN CONNECTION WITH YOUR USE OF THE WEBSITE OR SERVICES. IF YOU DO NOT AGREE TO THE TERMS, YOU ARE NOT AUTHORIZED TO USE THE WEBSITE OR SERVICES.

Definitions or Interpretation clause:

Agreement means and refers to the definition contained in the Indian Contract Act, 1872.

The Company herein refers to and means the “Echo of Arunachal”.
Terms means and constitutes legally binding agreement between the Company and the Users with respect to the browsing, accessing, using any contents in the website,
Service means any information, contents, products, subscriptions, premium, features which are provided by the Company.

Acceptance of term of service

By accessing or availing the Site or Service, you agree to be bound by these Terms. You hereby represent and warrant to the Company that you are at least eighteen (18) years of age or above and are capable of entering and adhering to these Terms and that you agree to be bound by the following terms and conditions. That if the users are under the age of 18, may access and use the website, only with the, supervision, involvement and guidance of their parents or legal guardians. That by accessing to the website the users agree to provide all the relevant details such as complete name, age, email address, residential address, contact number.

Changes

Please check these Terms periodically for changes. Your continued use of the site or Services after the posting of changes constitutes your binding acceptance of such changes. In addition, when using any particular services, you may be subjected to any posted guidelines, rules, product requirements or additional terms applicable to such services. All such guidelines, rules, product requirements or additional terms might be incorporated by reference into the Terms. The Company reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms at any time by posting the amended Terms with or without prior notice.
Further, the company reserves the right to suspend / cancel, or discontinue any or all products or service at any time or make modifications and alterations in any or all of the content, products and services contained on the website herein with or without prior notice.

Content Ownership:

Unless otherwise stated, the Site, Services and the Company Content are protected by copyright, trademark and other applicable laws in India. Except as expressly provided in these Terms, Company exclusively own all right, title and interest in the Site, Services, and the Company. The Company claims no ownership or interest in any Third Party Content and expressly disclaims any liability concerning those materials.

Limited License:

Subject to compliance with the terms herein contained, the Company hereby grants you to print or download any contents from this website only for non-exclusive, non-transferable, non-commercial and for personal use only. That the content may be downloaded or saved from this website for subsequent viewing only for personal use only and may not be used, copied, reproduced, distributed, transmitted, displayed, sold, or any other purposes whatsoever without the prior written consent of the company.

The registration of the service:

Unless otherwise provided, when you register, you are registering as a personal user of the E-Paper of the Echo of Arunachal. For registration of the services, users may be required to open an individual account by providing the company with the require, complete and accurate informations. The user will also have to choose a password and a user name of their own choices. The users are solely responsible for maintaining the confidentiality of the personal password and individual account. The company shall have the right to retain the registration information after cancellation or withdrawal of the registration.

Subscription:

Subscription to the subscription based Services/plan commences immediately after realisation of payment of the subscription fees by the Users. Subscription based Service may differ from plan to plan and the device from which you subscribe. Subscriptions packages and price may also vary in time and also as per the subscription plan. The subscription prices shall be determined by the Company, in its sole discretion. A user is required to provide the company a complete and accurate payment and other information required by the Company. Company uses third party payment gateway services for receiving payment from Users for its subscription based Services. Any payment or subscription paid by the user is non-refundable. The company reserve the right to change, modify or alter the subscription and membership fees without prior notice.

Subscription refund policy:

i) Subscribers are entitled to cancel their subscription within 30 days without giving any reason for doing so

ii) The deadline for cancelling an Order is 30 days from the date on which You subscribed to e-Paper.

iii) We will reimburse subscribers no later than 20 days from the day on which We receive the subscription cancellation request. We will use the same means of payment as subscriber used for the order, and subscriber will not incur any fees for such reimbursement.

iv) The usual mode of subscription refund transaction process will be online mode.

Pricing:
The company will made the subscription price clear to the user at the time of signing-up or during the signing-up process on Site. That In order to avail the subscription based Services, the users have to hereby agreed to pay the fees at the prices notified to the user at the time of purchase your preferred plan/ subscription. The company reserves the right to alter, change, and revise the price of the subscription/plan.

Taxes:

Apart from the subscription fees paid by the user, some additional taxes are applicable for availing of content on the website in India, including Goods and Services Tax (GST) or other applicable taxes.

Renewal and Cancellation:

The subscription will only be renewed automatically unless the user pay the fees of the subscribed plan availed by the users after the validity of the subscription plan is over. The user cannot cancel the subscription or any part of it until the end of current subscription plan/period. Although, the user can cancel the current plan by not making any further payment due to the current subscribed plan.

User Obligations:

The user shall hereby agree and assure the Company that the Site, service or any content shall be used for lawful purposes only, that in any manner whatsoever the user will not violate, breaches the laws, regulations, or other such laws which are provided under Central, State or any other international laws. The user shall agree to comply with the provision of the Information Technology Act, 2000 there under.

Discontinuation of service:

The Company possesses the right to alter, change, suspend, or discontinue temporarily or permanently, some or all of the content/services respect to any or all users, at any time without prior notice. It shall be the sole discretion of the company to discontinue any service/content. And in that event the Company will not be liable to for any modification, suspension, or discontinuance of the Services, provided if you are a paid subscriber and the Company suspends or discontinues the Services, the Company may, in its sole discretion, provide you with a credit, refund the price paid by you for the current/running service. The company has the right to retain any information or records that are required to be retained or preserved such as information after termination of your account.

Disclaimer of warranties and liability:

The User understand and agree that the Company provides the Services on ´as-is´ ´with all faults´ and ´as available´ basis. You agree that use of the Site or the Services is at your risk. The company does not make any warranties or guarantees whatsoever as to the accuracy, adequacy, reliability, completeness of the information of any particular situation. The company again does not make any warranties or guaranties regarding the uninterrupted, timely, error-free and the quality of any services. That further the company does not warrant or guarantee any content, information, or other material on the Site will meet the expectation or requirements of the users. Furthermore, The Company does not warranty against infringement of any third party intellectual property or proprietary rights. The company shall not be held responsible or liable for any content which is found to be derogatory, defamatory, obscene offending any public sensibilities or morals.

Indemnification:

You the user agree to indemnify, defend and hold harmless, the Company, and its shareholders, affiliates, successors, investors, directors, officers, employees, agents, and suppliers from and against any damages, liabilities losses, claims, and also including legal fees and expenses, arising out of:

1. your violation of terms of uses including or warranties made hereunder;
2. your use or misuse such as reproduced, distributed, transmitted, displayed, sold, any other purposes of or access to the Site or the Services;
3. your violation of any law and regulation of third party right such as any copy right, intellectual property or privacy right; or
4. any misuses of content or material.

5.any misrepresentation, act or omission made by you in connection with your use of the service/site.

The Company also reserves the right and liberty at its own expense to employ own and separate counsel to defend.

Force Majeure:

Non of the parties should be held liable for any default interruption or delay in access to the Site due to Force Majeure Event because of an act of God, war, hostilities, civil commotion, epidemics, lockdowns, strikes, lockouts and the case may be.

Applicable Law/jurisdiction:

The website which is originated from the state of Arunachal Pradesh and thus is governed by the any law established in Arunachal Pradesh in particular and the India and the world as a whole.

Non Waiver:

The company shall not be made liable for any express waiver or failure to exercise promptly any right under this agreement as continuing waiver or any expectation of non-enforcement.
